Arrival & Application
  • Once a foreign national arrives in the United States, they may apply for asylum at their port of entry no matter what their immigration status maybe. The application for asylum must be filed within one year of the individual’s arrival in the United States unless there were changed circumstances or extraordinary circumstances which delayed their application filing.
  • It does not matter if you entered without inspection, overstayed your visa, or were released into the US, you have a right to ask for asylum. To qualify for asylum, you must be able to provide evidence that you fear return to your home country due to persecution.
  • Your Roth & Lebe asylum attorney will be able to fill out and file your petition with the U.S. government on your behalf. Your lawyer will also be there to answer your questions every step of the way

Interview & Assessment
  • Filing for asylum gives you legal status in the US. You cannot be deported while your asylum case is in process. In addition, 150 days after you file for asylum you may file for work authorization.
  • After filing, the individual will be scheduled for fingerprinting and a background check will be conducted by the American Government.
  • Once that is completed, the individual applicant will receive aninterview notice for an interview with an asylum officer at one of the eightasylum offices or a district office, depending upon the applicant’s residencein the United States.
  • The Roth & Lebe team can help you file for work authorization while your application is pending and check on the status of your case, so you know where you stand.

Decision & Approval
  • Usually, the applicant will have to return to that office within about two weeks to receive the decision on the application. If the applicant is approved, they can remain in the United States in legal status and can apply for permanent residency one year after the grant of asylum.
  • Your Roth & Lebe lawyer can also represent you in court if necessary – and if you’re unfortunately referred for removal proceedings, your attorney will work hard to get you the best possible outcome.
